Quirks, Queries and Commentary—Exodus 22:2-3
Here is a curious thing. In the rules about protecting property, God allowed the property owner to kill the thief--but only if it happened at night. If it happened after sunrise he was guilty of bloodshed. Why did daylight make a difference?
It wasn't a carte blanche for a thief to steal during the day. He had to make restitution, even if it meant becoming a slave because he had no other means. Stealing certainly didn't pay.
